These Terms of Service ("Terms") govern your use of the NightMap mobile application and website (the "Service"), operated by NightMap ("we", "our", or "us"), based in Namibia. By creating an account or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
You must be at least 18 years old to use NightMap. By using the Service, you represent and warrant that you are 18 years of age or older. We reserve the right to terminate accounts of users who are found to be under 18.
You must be a human. Accounts created by bots or automated methods are not permitted.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.
You may not use another person's account without their permission. You may not create multiple accounts to circumvent bans or restrictions.
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms.

When you purchase a ticket through NightMap, you are purchasing a ticket to attend an event created by a third-party organiser. NightMap facilitates the transaction but is not the organiser of the event.
NightMap is not responsible for event cancellations, changes, or the conduct of organisers or other attendees. Refund requests for cancelled events should be directed to the organiser in the first instance.
Tickets are non-transferable unless the organiser has enabled ticket transfer on their event.
By creating an event on NightMap, you represent and warrant that:
Fraudulent events, fake listings or events that do not take place will result in immediate account suspension, forfeiture of payouts and potential legal action.
NightMap charges a commission of 8% on every paid ticket sold through the platform. This fee is deducted before payouts are processed to the organiser. Free events and RSVP-only events are not subject to commission.
Payouts to organisers are held for 48 hours after the event date before being released. NightMap reserves the right to freeze or withhold payouts if there is evidence of fraudulent activity, if the event did not take place, or if a significant number of complaints are received from attendees.
Organisers who wish to sell paid tickets or receive payouts are required to complete identity verification (KYC). This involves providing a government-issued ID and a selfie for verification by our third-party KYC provider.
By submitting verification documents, you consent to our KYC provider processing your identity information for the purpose of verification. Providing false or fraudulent identity documents is a serious violation of these Terms and may result in permanent account termination and referral to law enforcement.
NightMap operates a three-strike system for policy violations:
Severe violations — including fraud, identity theft, or creating events with intent to harm — may result in immediate permanent termination without prior strikes.
You retain ownership of content you post on NightMap, including event listings, profile photos and descriptions. By posting content, you grant NightMap a non-exclusive, royalty-free, worldwide licence to use, display and distribute that content in connection with operating and promoting the Service.
You are responsible for ensuring that content you post does not infringe the intellectual property rights of any third party.
We reserve the right to remove any content that violates these Terms or that we determine, at our sole discretion, to be harmful, offensive or inappropriate.
NightMap's rank system — Newcomer, Social Butterfly, Night Owl, Party Veteran, Legend, Icon — is based on verified event attendance recorded through the platform's QR code scanning system. Ranks are for social and profile purposes only and confer no monetary value or legal rights. We reserve the right to modify, reset or discontinue the rank system at any time.
The Service is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness or reliability of any event listing or user-generated content on the platform.
NightMap is a platform that connects event organisers with attendees. We are not responsible for the quality, safety or legality of events listed on the platform, or for the actions of organisers or attendees.
To the maximum extent permitted by applicable law, NightMap shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of revenue or personal injury.
Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app or by email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the Republic of Namibia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Namibia.
